Chapter 1 ANIMALS

3001 Adoption of the animal control ordinance of the County of Ventura.

The Animal Control Ordinance of the County of Ventura ("Chapter 4--Animals" of the County Code) is hereby adopted by reference as the Animal Control Ordinance for the City (herein after "Animal Control Ordinance") to the extent such does not conflict with the City’s Municipal Code. The City Clerk shall maintain a copy of the Animal Control Ordinance. (Ord. 640 § 1, 2002)

3002 Definitions.

Whenever the following words or phrases are used, they shall have the following meaning ascribed to them:

  1. "County" or "County of Ventura" means the City of Port Hueneme under the Animal Control Ordinance in those instances where the City has not contracted with the County of Ventura to provide Animal Control Services and in those instances where the Animal Control Ordinance makes reference to the jurisdictional boundaries of the County of Ventura;
  2. "Person" shall have the definition ascribed to such term by Section 1206 of this Code;
  3. "Poundmaster" shall mean the Police Chief of the City in those instances where the City has not contracted with the County of Ventura to provide animal control services; and
  4. "Unincorporated Territory" shall mean the jurisdictional boundaries of the City of Port Hueneme. (Ord. 640 § 2, 2002)

3003 Penalties.

The penalties for any violation of any provision of said Animal Control Ordinance and this Chapter 1 in its entirety (including without limitation activities that constitute nuisances) shall be infractions and misdemeanors as set forth in this Code for violations of this Code and shall also be deemed, for all purposes, public nuisances. The Council may instruct and direct the City Attorney to file an action to abate a public nuisance with respect to such violations. (Ord. 640 § 3, 2002)

3004 Annual dog licenses.

Provisions for dog licenses including fees shall be set in the manner described by the Council by Resolution and/or contract.

3005 Effect of zoning regulations.

Notwithstanding any provision of this Chapter, no person shall keep, or maintain, on any lot, or in any building or structure, any animal, mammal, fish, or fowl, for any purpose, except in strict conformity with the provisions of the City Zoning Regulations set forth in Article X of this Code.

3006 Unsanitary condition.

It shall be unlawful and a public nuisance for any person to keep or permit to be kept upon any premises, any animals, poultry or household pets in a foul, offensive, obnoxious, filthy or unsanitary condition. (Ord. 601 § 1, 1994)

3007 Leash law.

  1. It shall be unlawful for any person to suffer or permit any dog owned, harbored, or controlled to be on any public street, alley, lane, park or place of whatever nature open to and use by the public in the City of Port Hueneme unless such dog is securely leashed and the leash is held continuously in the hands of a responsible person capable of controlling such dog, or unless the dog is securely confined in a vehicle.
  2. It shall be unlawful for any person to suffer or permit any dog owned, harbored, or controlled to be on any private property in the City of Hueneme without the permission of the person owning or occupying said private property. (Ord. 607 § A, 1996)

3008 Pooper scooper required.

It shall be unlawful for any person having custody or control of a dog (except a guide dog used by the physically handicapped) to allow that dog to defecate upon any public beach, public street, alley, lane, park, school ground, private property or place of whatever nature open to and used by the public in the City of Port Hueneme and not promptly pick up and remove the feces in a wrapper, bag or container suitable for the purpose of picking up and removing the feces of such dog.
